2. The petitioner seeks bail in connection with Chainpur P.S. Case No. 46 of 2023 registered for the offence punishable under Sections 414/34 of the Indian Penal Code and Sections 25(1-b)a, 25(1-B)a, 25(1-AA) and 35 of the Arms Act.
3. This is the third attempt for grant of bail of the petitioner as earlier, twice the application for bail of the petitioner has been rejected.
4. At the place of occurrence, Bhola Rajbhar was found fleeing he was caught and he named one Gappi Rajbhar. Puppu Rajbhar was not named by Bhola Rajbhar but he is the brother of Gappi Rajbhar and son of Bhola Rajbhar. He is in jail since 07.08.2023 and claims clean antecedent.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-V, Kaimur at Bhabhua in connection with Chainpur P.S. Case No. 46 of 2023.
7. At the time of accepting bail bonds of the petitioner, the Court below will verify the criminal antecedent of the petitioner. If it is found that the petitioner has criminal antecedent, the Court below shall not accept the bail bonds of the petitioner and if it is found that the petitioner has clean antecedent, his bail bonds shall be accepted by the Court below.
