The petitioner is apprehending his arrest in connection with Jalalgarh P.S.Case no.194 of 2018 registered for offences punishable under Sections 147, 148, 341, 323, 325, 326, 307, 504, 506 and 34 of the Indian Penal Code.
Allegation against the petitioner is of assaulting by sword to Sumitra Devi causin injury on her finger Submission of the learned counsel for the petitioner is that there is case and counter case between the parties and the injury is not on the vital part of the body.
Heard learned A.P.P. also.
From the impugned order it appears that there was amputation of finger of the Sumtra Devi that shows the injury grievous in nature, as such I am not inclined to grant
Patna High Court Cr.Misc. No.4768 of 2019(3) dt.22-02-2019 2/2 anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.
With the aforesaid observation, this application is dismissed.
