JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-09-2017 The petitioner is aggrieved by an order passed by the Central Board of Secondary Education, Regional Office, Patna, whereby petitioner's request for change of his father's name from 'Suresh Prasad' to 'Suresh Kumar' in his Senior School Certificate Examination, 2013, has been rejected as time barred. It has been asserted in the writ petition that father's name of the petitioner was mentioned initially as 'Suresh Prasad' in the certificate issued by the Council for the Indian School Certificate Examination, New Delhi (hereinafter referred to as 'ICSE'). He had applied for change in the father's name, which came to be corrected in February, 2016 and, accordingly

Patna High Court CWJC No.10174 of 2017(2) dt.04-09-2017 2/3 father's name has been mentioned as 'Suresh Kumar' in the said examination certificate.

Based on name of the petitioner's father as entered in the Secondary School Examination Certificate issued by the ICSE, father's name was entered as Suresh Prasad while the petitioner was pursuing his Senior Secondary School Course. The same came to be entered in the certificate issued by the Central Board of Secondary Education in Senior School Certificate Examination, 2013. Only after the ICSE allowed correction in the name of the father of the petitioner in the year 2016, he approached the Central Board of Secondary Education for necessary correction, which has been refused by the impugned order as time barred.

Considering the facts and circumstances of the case, I think it proper to direct the Central Board of Secondary Education to consider the petitioner's case afresh without treating it to be time barred and allow correction in the father's name of the petitioner in Senior School Certificate issued by the Central Board of Secondary Education on the basis of entry which is existing as on date in the certificate of Secondary School Examination issued by the ICSE.
