JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-06-2019 Petitioner seeks bail in anticipation of his arrest in connection with Madhepura Mahila P.S. Case No. 71 of 2017 registered for the offences punishable under Sections 498A, 341, 323, 504/34 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.

Allegation against the petitioner is of subjecting his wife-informant to cruelty and harassment with respect to demand.

Submission of learned counsel for the petitioner is that the matter has been settled between the parties and a divorce proceeding under Section 13B(1) of Hindu Marriage Act has been initiated and decree of mutual divorce has been passed by the court of Principal Judge, Family Court, East,

Heard learned APP and learned counsel for opposite party No.2, who has also conceded the above fact and submitted that settlement has been reached between the parties. In view of above facts and circumstances, this application is allowed and the provisional bail granted to the petitioner vide order dated 5.2.2019 is confirmed. (Vinod Kumar Sinha, J) spal/- U T
