1. Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 318(4), 338, 336(3), 340(2) and 61(2)of the Bharatiya Nayaya Sanhita, 2023.
3. The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and are purchasers of land. It is next submitted that informant alleges that the petitioners purchased government land which is an offence.
4. It is next submitted that petitioners are innocent
Patna High Court CR. MISC. No.8153 of 2025(2) dt.06-03-2025 2/3 purchased and they purchased the land vide registered sale deed. It is also submitted that after the instant case came to be instituted, the vendor of the petitioners filed Title Suit No.317 of 2024 against the State of Bihar seeking declaration of their title.

Learned A.P.P. opposes the anticipatory bail application and submits that though it has been pleaded and submitted that vendor of the petitioners filed Title Suit No.317 of 2024 against the State of Bihar, but then, it has not been specifically pleaded that the Title Suit No.317 of 2024 has been filed against the State of Bihar, on which the learned counsel appearing on behalf of the petitioners asserts and submits that the aforesaid Title Suit has been filed by the vendor of the petitioners against the State of Bihar.

Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Sadar P. S. Case No.670 of 2024, subject to the conditions laid down under Section
Patna High Court CR. MISC. No.8153 of 2025(2) dt.06-03-2025 3/3 438(2) of the Cr.P.C.
7. The application stands allowed.
8. However, the informant would be at liberty to file an application seeking cancellation of anticipatory bail granted to the petitioners if State of Bihar is not impleaded as defendant in Title Suit No.317 of 2024.
