Petitioner seeks bail in a case registered for the offences punishable under Sections 20 and 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
From possession of the petitioner, 10 Kg. of ganja was recovered. Petitioner was arrested on 02.08.2017 along with 10 Kg. of ganja in a Scorpio vehicle. Petitioner is alleged to be the owner of the ganja.
Earlier prayer for bail was refused on 11.01.2018 with direction to the trial Judge to expedite the trial and conclude the same within nine months.
The impugned order reveals that charges have already been framed. However, no witnesses have turned up till now. Considering the nature of allegation, I am not inclined
Patna High Court CR. MISC. No.2203 of 2019(5) dt.08-05-2019 2/2 to enlarge the petitioner on bail in connection with Chandramandi Police Station Case No. 70 of 2017 (N.D.P.S. Case No. 07 of 2017 pending in the court of learned 1st Additional Sessions Judge, Jamui.
Hence, prayer for bail is refused.
