The petitioner seeks bail in a case registered for the offences punishable under Sections 307, 498A and other Sections of the Indian Penal Code. Later on Sections 302, 201 of the Indian Penal Code were added.
The petitioner is the husband. The wife of the petitioner made very specific allegation that even after the marriage solemnized 25 years ago, the petitioner used to assault her. The petitioner sprinkled kerosene oil and set her ablaze. It is submitted that the informant got 90 per cent burn injury and she was not in a position to make her statement. The victim made her statement at Magadh Medical College Hospital in presence of her brother and narrated the entire story.
Patna High Court Cr.Misc. No.30664 of 2015 (2) dt.14-08-2015 2/2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.
However, the trial court is directed to expedite the trial and conclude the same within one year from the date of receipt of this order.
