Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 341, 323, 327, 384, 386, 120(B) of the Indian Penal Code and 27 of Arms Act. As per the prosecution case, on the alleged date and time of the incident, this petitioner along with co-accused abused and assaulted the informant and tried to dispossess him. They demanded Rs. 25 lakhs as Rangdari and threatened to kill him.
Learned counsel for the petitioner submits that there is delay in lodging of the F.I.R and there is no explanation about the delay. There is also a land dispute between the parties. There is no specific allegation of any overt act against the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M, East Champaran, Motihari in Turkuliya (Raghunathpur) P.S. case no.174 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
