Petitioner is languishing in custody since 16.12.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 302 of the Indian Penal Code.
There is specific accusation of causing firearm injury to the husband of the informant by accused Raghunath Bhagat. Though petitioner was one of the associate of the assailant Raghunath Bhagat.
It is submitted by the learned counsel for the petitioner that accusation of causing firearm injury is not against the petitioner. Moreover investigation has already concluded.
Considering the aforesaid facts, let the above
Patna High Court Cr.Misc. No.25275 of 2015 (2) dt.21-07-2015 named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Assaon P.S. Case no. 03 of 2000.
Since the case was registered in 2000 and petitioner was arrested in 2014, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if in two eventualities i.e. if the petitioner defaults for two consecutive occasions or gets substantially involved in some serious nature of offence.
