The petitioner seeks bail in a case registered under Section 124A of the Indian Penal Code and 25(1-B), 26, 35 of Arms Act and 3⁄4 of E.S. Act and Section 17 of C.L.A. Act. Allegation is that the accused persons including the petitioner were made planning to commit explosion in Mauza Teldiha and huge quantity of explosive substances, bomb, live cartdiges, S.L.R. and A.K. 47 are recovered.
It has been submitted on behalf of the petitioner that the petitioner is in custody 1.6.2018. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. No arms is said to
Patna High Court CR. MISC. No.6122 of 2019(6) dt.20-08-2019 2/2 have been recovered from the conscious possession of the petitioner. Other co-accused has been granted bail vide Cr.Misc.No.44480 of 2018. It is further submitted that the petitioner will co-operate during trial.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge III, Aurangabad in connection with S.Tr.
