JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State. In spite of valid service of notice, nobody appears on behalf of informant/opposite party no. 2. The petitioner apprehends his arrest in a case registered for the offence under Sections 406, 379/34 of the Indian Penal Code.
As per the prosecution case, this petitioner, being supervisor, with the help of one security guard Arjun Mandal committed theft in godown and took away 1600 bags of maize for the purpose of selling.
It is submitted on behalf of petitioner that it was this petitioner, who gave this information to the informant. There was no shortage of bags of maize in the said godown. Earlier, on
Patna High Court CR. MISC. No.4799 of 2022(4) dt.13-12-2022 2/2 27.07.2021, total bags of maize was 30930 and thereafter, on 16.11.2021, the auditor of the company came and found total 12650 bags and thereafter transaction of 6000 bags was made and total 6650 bags were found, which is evident from the stock report of the company and as such, there was no shortage of bags of maize. Therefore, allegation levelled against this petitioner is baseless, false and concocted. Petitioner has got clean antecedent.
Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar in connection with Korha P.S. Case No. 531 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
