3. Earlier also, when the matter was taken up on 17.10.2024, there was none to represent the petitioner.

A counter affidavit has been filed on behalf of respondent no.4, wherein a categorical averment has been made that against the order of dismissal, the petitioner has preferred statutory appeal, which also came to be dismissed. Being aggrieved, the petitioner also preferred memorial, which resulted into same fate with the dismissal of the memorial. The

Patna High Court CWJC No.1926 of 2019(4) dt.24-10-2024 2/2 order passed in memorial has not been questioned herein.

5. Be that as it may, considering the fact that there is none to represent the petitioner, the writ petition stands dismissed for non-prosecution.
