JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State as well as the learned counsel for the informant.

The petitioner is in custody in a case registered under Sections 302 and 307 and other allied Sections of the Indian Penal Code.

The prosecution case, in brief, is that on the alleged date and time of the occurrence, the father of the informant was going to a shop from his house to bring some articles and when he reached the lane of Sanjay Chaudhary, accused Shyamsundar Chaudhary caught the father of the informant and Sanjay Chaudhary assaulted his father with Khanti on his head, as a

On hulla, when the informant, Arun and Indal came running there to save his father, Arun Chaudhary assaulted the informant with rod on his head, Sanjay Chaudhary assaulted Arun with Khanti and Rohi Chaudhary assaulted to Indal with rod. All the injured were taken to the Sadar Hospital for treatment. However, the father of the informant died during the course of treatment. On behalf of the petitioner, it has been submitted that the petitioner is in custody since 8.3.2015. Charge sheet has been submitted in the case. The petitioner has no criminal antecedents. As per the allegation, the main allegation is against Sanjay Chaudhary, who is said to have assaulted on the head of the deceased. There is no specific allegation attributed against this petitioner.

On behalf of the State and the informant, it has been submitted that the petitioner is named in the F.I.R. and omnibus allegation is against him.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the
