The petitioner seeks bail in a case registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The petitioner is alleged to have assaulted Sabir Ansari with Dabiya on his head.

It is submitted that there is counter version. Sabir Ansari got one lacerated wound on his head. The opinion with regard to nature of injury was kept reserved, but the same is yet to be received. C.T. Scan was done and depressed fracture on frontal tissue was found, therefore, the injury was opined to be grievous in nature.

Considering the facts aforesaid and the fact that there is no repetition of blow, there is counter version also and the

No.25457 of 2015 (3) dt.04-08-2015 2/2 petitioner is in jail since 05.05.2015, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in Bounsi P.S. Case No. 01 of 2015.
