JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Katoria P.S. No. 137 of 2018 for the offence under Sections 341, 323, 324, 307, 325, 504/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Referring to the prosecution story he submits that allegation of assault is not against this petitioner but against Basudev Tanti and Nourangi Tanti.

Considering the aforesaid, let the petitioner named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Katoria P.S. Case No.137
