JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-04-2022 Heard learned counsel for the petitioners and the State. Petitioners seek regular bail in a case registered for the offence punishable under section 8c and other sections of the NDPS Act.

As per the prosecution case, 1.360 grams Smack has been recovered from the possession of petitioner no.1, whereas 940 mg. Smack was recovered from the possession of petitioner no.2.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. He submits that less than small quantity Smacks have been recovered from the possession of the petitioners.

Patna High Court CR. MISC. No.5334 of 2022(2) dt.04-04-2022 2/2 Petitioners claim clean antecedent and they are in custody since 7.11.2021.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the quantity of recovery and period of custody of the petitioners, prayer for bail of the petitioners is allowed. Let all the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Jehanabad in NDPS Case No. 11 of 2021/Karpi Police Station Case No. 209 of 2021.
