The petitioners are languishing in custody since 17.03.2015 in connection with Samastipur (Mufassil) P.S. Case No. 156 of 2014 for the offences instituted under Sections 302 and 201/34 of the I.P.C.

The prosecution story, in brief, is that on 30.04.2014 the informant was deputed in the Parliamentary Election, 2014, at that time he received information that a dead body of a lady is lying in Baghar. On such information when he reached on the east of Loco Shed then he saw that a dead body of 35 years old lady is lying whose both legs have been cut. No body has identified the said

Patna High Court Cr.Misc. No.25299 of 2015 (3) dt.02-09-2015 2/2 dead body. It is further said that lady has been killed some where else and her dead body has been thrown in Baghar. It has been submitted on behalf of the petitioners that the petitioners are in custody since 17.03.2015 and the charge sheet has been submitted in the present case. Petitioners have got no criminal antecedent. The petitioners have been made accused in the present case merely on the basis of suspicion. On behalf of the State it has been submitted that the petitioners are not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Samastipur, in connection with Samastipur (Mufassil) P.S. Case No. 156 of 2014.
