Heard learned counsel for the petitioner and the learned APP for the State.

This is an application for regular bail on behalf of the petitioner for the offences alleged under sections 363 and 366A/34 of the Indian Penal Code.

As per allegation accused persons including the petitioner enticed away minor daughter of the informant. Learned counsel for the petitioner has submitted that victim in her statement under section 164 Cr.P.C did not support the factum of abduction and the petitioner is in custody since

Considering the above mentioned facts and circumstances, let the petitioner above named be released on bail on furnishing bail bond of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Ms. Sobhana Swetani, Judicial Magistrate Ist Class, Vaishali at Hajipur in connection with Baligaon P.S. Case no. 48 of 2021 with condition that if the petitioner is found involved in future in similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which the matter shall be brought to the notice of this Court.
