The petitioner is languishing in custody since 23.01.2015 in a case registered for the offences punishable under Sections 302 and 328/34 of the Indian Penal Code. It is alleged that the son of the informant was administered poison and thrown near the cremation ground. The informant claims that the victim suggested that he was being administered poison by this petitioner.
It is submitted by learned counsel for the petitioner that due to enmity suspicion has been raised and the post-mortem report suggests no external injury particularly
Patna High Court Cr.Misc. No.25610 of 2015 (2) dt.23-07-2015 2/2 resisting injury and viscera has been preserved. The report of the FSL is not on the record and the investigation has already concluded.
A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the fact that the accusation is not being corroborated by the post-mortem report which does not suggest any resisting injury, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkauliya P.S. Case No. 827 of 2014.
