JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 31-07-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 143, 147, 148, 149, 341, 323, 353, 332, 333, 338, 435, 436, 307, 427, 504, 120(B), 395, 412 of the Indian Penal Code, Section 27 of the Arms Act and Section 3, 4 of the Prevention of Damage to Public Property Act.

The petitioner is accused of being part of the

Patna High Court CR. MISC. No.8543 of 2023(3) dt.31-07-2023 2/3 mob which had tried to commit arson and riot. It is submitted by learned counsel for the petitioner that 72 persons including the petitioner and 500-700 unknown persons have been made accused in connection with an agitation which took place. There is general and omnibus allegation against the petitioner. The petitioner is a student and languishing in custody since 23.07.2022. Moreover, other similarly situated coaccused has been granted bail by a coordinate Bench of this Court vide order dated 09.12.2022 passed in Cr. Misc. No. 55936 of 2022.

Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Sessions
