====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 10-07-2023 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 308, 325, 504 and 34 of the Indian Penal Code. The informant alleges that Randhir Singh assaulted him by khanti on his left hand causing fracture and Ashok Singh assaulted him by lathi causing injury on head. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.12343 of 2023(2) dt.10-07-2023 2/3 petitioner nos. 1, 2, 4 and 5 are persons with clean antecedent and petitioner no. 3 has antecedent of one case. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case, it is next submitted no doubt one of the injuries on hand is grievous but then that is on non-vital part of the body, it is further submitted that the petitioners and the informant are related and on trivial issue the dispute had arisen in which altercation took place leading to injury on both sides, it is further submitted that on intervention of well wishers the informant and the petitioners have entered into a compromise. It is next submitted that informant is not willing to pursue the case further. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Pandaul

However, the learned Trial Court before accepting the bail bonds of the petitioners shall verify from the informant whether the compromise entered in between him and the petitioners is without any pressure or coercion and in the event, if it is found that any pressure or coercion was exerted on the informant for entering the compromise then the present anticipatory bail order shall not be given effect to.
