The petitioner is languishing in custody since 21.01.2016 in connection with Motipur P.S. Case No. 13 of 2016 for the offences instituted under Sections 399, 402, 414 of the Indian Penal Code and 25(1-b)a/26(II) and 35 of the Arms Act. The prosecution story, in brief, is that in course of regular checking of NH-28, the informant got secret information about assemblage of miscreants and apprehended the accused named in the F.I.R including the petitioner and some incriminating articles were recovered from them. A seizure list was also prepared giving rise to the present case.
It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.18168 of 2016 (3) dt.01-08-2016 2/2 petitioner is in custody since 21.01.2016. Charge-sheet has been submitted in the present case. He has got no criminal antecedent. There is no allegation of tempering of evidence against the petitioner. There is no compliance of Section 100 Cr.P.C. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, (West) Muzaffarpur in connection with Motipur P.S. Case No. 13 of 2016.
