JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-03-2019 Petitioners seek bail in anticipation of their arrest in connection with Birpur P.S.Case No. 62 of 2018 registered for the offences under Sections 302/34 of the IPC. Allegation against the petitioners is of committing murder of brother of the informant by strangulation of his neck by rope.

Submission of learned counsel for the petitioners is that they have falsely been implicated and petitioners are not assailants as he has committed suicide and post mortem report disclosed that cause of death of the deceased is strangulation by rope.

Heard learned APP also, who has opposed the prayer for anticipatory bail of the petitioners.

Patna High Court CR. MISC. No.4957 of 2019(4) dt.12-03-2019 2/2 Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioners, rather they have to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

With the above observation, this application is dismissed.
