JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 26.11.2013 in a case registered under section 302 and other minor sections of the Indian Penal Code as well as 27 of the Arms Act. Petitioner is not named in the first information report but in course of investigation, the informant claimed that it was petitioner, who had hired tempo and committed murder of the deceased. Apart from the aforesaid statement of the informant the mobile location of the petitioner was also found in the concerned area and except the aforesaid material, there appears to be nothing against the petitioner.

Patna High Court Cr.Misc. No.26678 of 2014 (3) dt.13-01-2015 2/2 Admittedly, the Tempo of the deceased was recovered in abandon condition under the jurisdiction of Bela Police station.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, West Muzaffarpur in connection with Kurhani P.S.Case No. 57 of 2013.
