JUSTICE SHIVAJI PANDEY ORAL ORDER 13-05-2020 Perused the records of this case and heard learned counsel for the State through virtual court proceeding. In the present case, the petitioner is seeking bail in connection with Excise Case No. 533 of 2019 registered for offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act.

As per allegation, about 14 liters of illegal liquor was recovered from the hut of the petitioner, however, counsel for the petitioner submits that he is in judicial custody since 23.12.2019 having no criminal antecedent.

Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on his personal bond due to the circumstance of total lock down

Patna High Court CR. MISC. No.12943 of 2020(3) dt.13-05-2020 2/2 on account of pandemic Covid-19 to the satisfaction of Additional District Judge-II-cum-Special Judge, Excise, Samastipur in connection with Excise Case No. 533 of 2019 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
