The petitioner is languishing in custody since 11.11.2013 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

It is alleged that the petitioner and Bijay Singh caused injury to the son of the informant with spear, who subsequently succumbed to the injury.

It is submitted by learned counsel for the petitioner that the injury was caused by the petitioner on the thigh of the victim.

The report of the learned trial court dated 29.01.2015 reflects that seven witnesses have been examined. In

Patna High Court Cr.Misc. No.25877 of 2014 (05) dt.03-03-2015 2/2 the circumstances, this Court is not inclined to interfere. Accordingly, the prayer for bail of the petitioner is rejected in connection with Sessions Trial No. 83 of 2014 arising out of Sikarhata P.S. Case No. 75 of 2013 pending in the court of learned Ad hoc Additional Sessions Judge IIIrd, Bhojpur at Ara.

It is expected from the learned trial court to conclude the trial expeditiously.
