Learned counsel for the petitioner submits that this is the second attempt of the petitioner to seek bail as earlier his bail application was rejected by order dated 31.01.2022 in Cr. Misc. No. 29654 of 2021.
The petitioner seeks bail in a case registered for the offences punishable under Sections 364, 365, 379, 386, 302, 201, 120(B), and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has remained in custody for more than two years and the trial has commenced but out of eleven witnesses only seven witnesses have been examined. Patna High Court CR. MISC. No.6610 of 2023(2) dt.01-02-2023 2/2 situated co-accused have been granted bail by Co-ordinate Benches of this Court as would be evident from Annexure-5 series.
Considering the period of custody and the stage of trial made by the learned counsel for the petitioner, the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bettiah (Town) P.S. Case No. 498 of 2020.
In the event, if the learned trial court comes to a conclusion that petitioner after his release is trying to delay the trial in any manner. The learned trial court shall forthwith cancel his bail bonds after recording reasons and shall take all coercive steps to ensure that petitioner is behind bars. (Satyavrat Verma, J) Shivam/- U T
