Heard learned counsel for the parties.
Petitioner apprehends arrest in a case registered for the offences punishable under Sections 419/120B and other allied sections of the Indian Penal Code.
Prosecution's case, in brief, is that the petitioner fraudulently tried to procure appointment as a constable in Bihar Police by impersonation as his handwriting and signature on the OMR sheet taken during written examination differed from that taken during physical examination.
Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case only on suspicion. Petitioner is a student pursuing his B.A. course and has got no criminal antecedent. Similarly situated coaccused has already been allowed anticipatory bail by a bench of this Court vide order dated 10.5.2019, passed in Cr.Mis.No. 21660 of 2019.
Considering the facts of the case, let the petitioner, above named, in the event of surrender before the Court below
Patna High Court CR. MISC. No.11632 of 2020(2) dt.30-06-2020 2/2 within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Judge XIV cum Additional Chief Judicial Magistrate XIV, Patna in Gardanibagh Police Station Case No. 500/2018, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
