Heard learned counsel for the petitioners no. 1,2 and 4 and the State.
Petitioners apprehend arrest in a case registered for the offence punishable under sections 307/379/34 and other ancillary sections of the Indian Penal Code.
As per the prosecution case, petitioners assaulted the informant and his brother by means of iron rod and khanti and snatched gold locket from the informant.
Patna High Court CR. MISC. No.6975 of 2023(2) dt.11-05-2023 2/2 Learned counsel appearing for the petitioners submits that due to land dispute, simple marpit took place between the parties. Doctor has found simple injuries. Allegation of assault is general against the petitioners and no specific overt act has been alleged against them. Petitioners claim clean antecedent. Considering the aforesaid facts of the case, prayer for bail of all the petitioners no. 1,2 and 4 is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners no. 1,2 and 4, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in Ghosi Okari OP Police Station Case No. 679 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
