JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 The petitioner is languishing in custody since 28.04.2015 in connection with Mirganj P.S. Case No. 183 of 2014 for the offences instituted under Sections 498(A), 406 of the I.P.C. and 3⁄4 of the D. P. Act.
Heard learned counsels for the petitioner, informant and learned counsel for the State.
The accusations are of demand of dowry and on nonfulfilment of the same the informant was tortured by the accused persons.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.04.2015 and for the same offence, two different cases have been instituted against the petitioner. It is further submitted that the petitioner is ready to deposit amount of
Patna High Court Cr.Misc. No.25969 of 2015 (2) dt.23-07-2015 2/2 Rs. 1000/- per month in the court below which shall be released in favour of the informant.
On behalf of the State and informant it has been submitted that the petitioner is the husband and named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner shall deposit amount of Rs. 1000/- per month in the court below which shall be released in favour of the informant and on doing so, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gopalganj in connection with Mirganj P.S. Case No. 183 of 2014.
