JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-06-2020 The petitioner seeks bail in connection with Sessions Trial No. 874 of 2019 (arising out of Nawbat Pur P. S. Case No. 331 of 2017) instituted for the offences under Sections 304(B), 201, 302 and 34 of the Indian Penal Code.

The petitioner is the husband of the deceased and is in custody since 08.01.2018.

The report of the court below indicates that charges in this case have already been framed on 13.11.2019 and summons have been issued against non-official witnesses. Bailable warrant also has been issued for compelling the attendance of the witnesses.

Patna High Court CR. MISC. No.6436 of 2020(4) dt.08-06-2020 2/2 Regard being had to the nature of accusation against the petitioner, I am not inclined to grant bail for the present.

However, the trial court is directed to conclude the trial within a period of nine months from the date of production/receipt of a copy of this order. If the trial is not concluded within that period, the petitioner would be at liberty to approach the trial court and seek bail. The petition stands disposed off with the aforesaid observation.
