JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-02-2020 Petitioner seeks bail in connection with Special Case No. 207 of 2019, arising out of Mehandiganj P.S. Case No. 191 of 2019, registered for the offences punishable under Sections 354, 354A (I) and 354(D) of the Indian Penal Code and Sections 7/8 of POCSO Act.

There is allegation against the petitioner of molestation of minor daughter of the informant and earlier also he misbehaved with her.

Submission of learned counsel for the petitioner is that they are neighbours and he has falsely been implicated and he is in custody for three months, matter was compromised between the parties, charge sheet has been submitted and he is ready to abide by any condition that may be imposed on him. Heard learned APP also.

No.5738 of 2020(2) dt.03-02-2020 2/2 In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-I-cum-Special Judge, POCSO Act, Patna, in connection with Special Case No. 207 of 2019, arising out of Mehandiganj P.S. Case No. 191 of 2019, subject to the condition that petitioner shall not tamper with the evidence and not to threat the informant and her family members.
