JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 30-06-2016 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner seeks bail in connection with Bairgania P.S. Case No. 230 of 2015 registered for the offences punishable under Sections 25(1-B)a, 26(ii)/35 of the Arms Act. Allegedly, from possession of the petitioner one country made pistol and one live cartridge were recovered on 07.12.2015 and since the he is in custody but earlier also he was an accused in Majorganj P.S. Case No. 399, 402 of the Indian Penal Code and Sections 25(1-B)a, 26(ii)/35 of the Arms Act. In the facts and circumstances stated above, considering the criminal antecedent of the petitioner, at present, this Court is not inclined to enlarge the petitioner on bail, accordingly, his such prayer stands rejected.

However, the learned trial court is directed to expedite

Patna High Court Cr.Misc. No.21009 of 2016 (4) dt.30-06-2016 the trial and conclude the same as early as possible, preferably within four months from the date of receipt/production of a copy of this order, failing which the petitioner, if at no fault, may renew his prayer for bail.
