JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 149, 447, 323, 504, 342, 435, 427 of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of C.L.A. Act.

Petitioner is not named in the first information report and submission on behalf of the petitioner is that the name of petitioner came in this case on the basis of information given by spy of the police and after that one co-accused was arrested and confessed his guilt. It is further submitted that moreover, one coaccused, namely, Lala Yadav, having more or less similar allegation, has already been granted privilege of bail.

Patna High Court Cr.Misc. No.18634 of 2016 (2) dt.03-05-2016 2/2 No doubt, petitioner carries criminal antecedent of several cases but in the present case, except the aforesaid material, there is nothing against him.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 243 of 2010.
