JUSTICE SUDHIR SINGH ORAL ORDER 25-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner is in custody since 20.06.2015 in connection with Jamui P.S.Case No.162 of 2012 registered for the offence under Sections 387/34 of the IPC and Section 27 of the Arms Act. As per the prosecution case, it is alleged by the informant that informant disclosed before the police that extortion money was demanded from him on phone taking the name of one Ranjit Don and Munna Sao, Later on, petitioner was arrested and has been made accused in this case.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.06.2015. Chargesheet has been submitted in the case. Petitioner has falsely been implicated in the

Patna High Court Cr.Misc. No.18061 of 2016 (3) dt.25-05-2016 present case. The mobile which is said to have been used in the alleged crime do not belong to the petitioner. The said fact is evident from para-34 of the case diary. The other co-accused has been granted bail by this Court vide Cr.Misc.No.30004 of 2013. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjay Kumar, Judicial Magistrate, Ist Class, Jamui in connection with Jamui P.S.Case No.162 of 2012.
