The petitioner seeks bail in anticipation of his arrest in connection with Excise Complaint Case No. 180C2 of 2020 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.
15 litres of liquor kept in a plastic jerkin was found from the veranda of the house of the petitioner. The learned counsel for the petitioner has urged for grant of anticipatory bail on the ground that the veranda is an open space which is accessible for all and sundry. Thus, it has been argued that the recovery cannot be saddled on

He further submits that the petitioner does not have criminal antecedents.
However, considering the fact that the recovery of liquor has been made from the veranda of the house of the petitioner, I am not inclined to grant anticipatory bail to him. The prayer for anticipatory bail is rejected. (Ashutosh Kumar, J) sunilkumar/- U T
