JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 18.12.2015 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code, Section 27 of the Arms Act and Sections 3, 4, 5 of Explosive Substance Act.

Petitioner is not named in the first information report but from perusal of the impugned order, I find that in course of investigation, the name of petitioner surfaced in this case on the basis of confidential information of spy of the police and after that some co-accused were arrested and confessed their guilt disclosing the name of the petitioner. The petitioner was also arrested and he, too, made his confessional statement. It appears

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Jamui in connection with Sikandra P.S. Case No. 135 of 2015.
