ANJANA MISHRA ORAL ORDER 28-05-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is custody since 16.07.2014 in connection with Bankankhi P.S. Case No.162/14 registered for the offences punishable under Sections 364, 365, 368/34 of the Indian Penal Code and subsequently, Section 302/201 of the Indian Penal Code has been added.

Learned counsel for the petitioner submits that though he is not named in the First Information Report yet petitioner's name has surfaced in the confessional statement of one co-accused Ranjan Kumar who has stated in his confession before the Police that the petitioner was also standing there when the murder was being committed.

Patna High Court Cr.Misc. No.12846 of 2015 (2) dt.28-05-2015 Considering the vagueness of allegations and also the fact that the confessional statement made before the Police has no evidentiary value and the petitioner is having a clean antecedent, let the petitioner Pankaj Kumar Yadav be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Purnea in connection with Banmankhi P.S. Case No. 162/2014.
