Petitioner is not named in the first information report and his name came in this case in confessional statement of coaccused. Subsequently, petitioner was arrested and he too made his confessional statement and it appears that except the aforesaid material as well as some criminal antecedent of the petitioner, there is nothing against the petitioner.
