JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-03-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 341, 302, 120-B of the Indian Penal Code.

Petitioners along with several other accused are named in the first information report with general allegation of assault. The photostat copy of postmortem report attached with the case diary goes to show that altogether three injuries were found on the person of the deceased. Out of them, two injuries were bruises whereas one injury was found on the head of the deceased.

No.3334 of 2019(4) dt.28-03-2019 2/2 Submission on behalf of the petitioners is that there is case and counter case between the parties and as a matter of fact, the prosecution party was aggressor and that is the reason wife of petitioner no. 1 lodged case against the prosecution party for the occurrence of the same day.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioners are in jail custody since 11.09.2018 and the investigation of the case has already been completed against them, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-2nd, Bhojpur at Ara in connection with Sessions Trial No. 385 of 2018 arising out of Chauri P.S. Case No. 37 of 2018.
