The petitioner seeks bail in a case registered for the offence punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act and 17, 18, 19, 20, 21 and 23 of the Unlawful Activities (Prevention) Act.

The allegation is that petitioner took part as one of the members of the unlawful assembly and during raid a country made pistol and a live cartridge were recovered from his possession. He was also present at the place of unlawful assembly.

It is submitted on behalf of the petitioner that he has no criminal antecedent and has been in custody since 16.12.2014. After investigation chargesheet has also been submitted and there is no chance of tampering with the witnesses.

Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/-

Patna High Court Cr.Misc. No.29536 of 2015 (2) dt.13-08-2015 2 / 2 (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Court, Muzaffarpur, in Meenapur P.S. Case No. 489 of 2014 with the following conditions :

1. One of the bailors will be the close relative of the petitioner.

2. The petitioner will not indulge in similar or in any other offence.

3. The petitioner will be well represented in the court.

4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
