The present application has been filed for modification of the order dated 10.03.2016 passed in CWJC No. 2274 of 2015 by which the writ petition was disposed off with liberty to the petitioner to move before the Insurance Ombudsman. A time frame was also fixed for the same. However, learned counsel for the petitioner submits that the Insurance Ombudsman does not have the jurisdiction to look into the matter as it is beyond his pecuniary jurisdiction and accordingly, it would be the Bihar State Consumer Disputes Redressal Commission, Patna.

Accordingly, order dated 10.03.2016 passed in CWJC No. 2274 of 2015 stands modified to the extent that the liberty given in terms of the order shall be for the petitioner to move before the Bihar State Consumer Disputes Redressal Commission, Patna within two weeks from today.

In view of the Court fixing a time frame for disposal of the matter, as per the order dated 10.03.2016, keeping in mind the urgency, the Court would request the State Commission to dispose off the matter on priority basis expeditiously within a period of four months.

The Court has been assured by learned counsel for the parties that they shall co-operate in disposal of the case. The application stands disposed off in the aforesaid terms.
