JUSTICE MADHURESH PRASAD ORAL ORDER 10-01-2020 The instant writ petition has been filed under Articles 226 and 227 of the Constitution of India whereby the writ petitioner has complaint to the District Magistrate, Motihari, that he is being intimidated and demands are being made to extort some money from him by certain police officials for facilitating verification in respect of petitioner's application for issuance of Arms License. Till issuance of Arms License, he has prayed that order should be issued for protection of his life and property. Learned counsel for the State, referring to the order dated 08.08.2017 issued by the Sub Divisional Magistrate, Pakridayal, submits that the petitioner's application for the Arms License
Patna High Court CR. WJC No.867 of 2017(2) dt.10-01-2020 2/2 has been rejected since the petitioner has been found to be a member of antisocial and illegal organization. Since the petitioner's application for Arms License has already been rejected, it has been submitted that in respect of his such rejection, the petitioner should now avail of his remedy in accordance with law and that the points raised in the instant writ petition do not survive any more.
No rejoinder has been filed controverting the stand of the State taken in the counter affidavit.
When the matter is called out, none appears on behalf of the petitioner.
