JUSTICE PARTHA SARTHY ORAL ORDER 23-07-2021 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Phulwarisharif P.S. Case no. 1049 of 2019 registered under section 395 of the Indian Penal Code.

As per allegation in the FIR, 7 to 8 accused persons broke open the door of the house of the informant, tied them up and took away ornaments worth Rs. 7 lacs. It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in course of investigation on the confessional statement of co-accused made before police. No incriminating article has been recovered from the petitioner's possession nor has he been put on TI Parade inspite of being in

Patna High Court CR. MISC. No.15720 of 2021(2) dt.23-07-2021 2/2 custody since 4.12.2019. His case stands on a similar footing to that of co-accused Ravinath who has been enlarged on bail vide order dated 14.12.2020 passed in Cr. Misc. no. 28235 of 2020. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the period in custody together with the investigation having concluded without putting the petitioner on TI Parade and grant of bail to co-accused, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Phulwarisharif P.S. Case no. 1049 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, IX, Patna.
