JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-07-2017 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor representing the State of Bihar.
This application, for grant of anticipatory bail, arises out of Shambhuganj Police Station Case No. 169 of 2016, disclosing offences under Sections 420/467/468/471/ 120B/34 of the Indian Penal Code.
The petitioner is working as Block Teacher. She has been made accused on the allegation that the documents, which she had produced at the time of her appointment were forged.
Learned Counsel appearing on behalf of the petitioner has submitted that no document, which the petitioner had produced at the time of her appointment, was forged and she is ready to present herself before the police or the Court, as and when required, for investigation.
Patna High Court Cr.Misc. No.25638 of 2017 (2) dt.07-07-2017 2/2 He has also submitted that similar circumstanced coaccused, Mukesh Paswas, has been allowed anticipatory bail by this Court, vide order, dated 01.07.2017, passed in Criminal Misc. No. 24723 of 2017.
Considering the above submission, this application is allowed.
Let the petitioner, Punam Devi, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Banka, in connection with Shambhuganj Police Station Case No. 169 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bond shall be liable to be cancelled.
