JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-03-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 8/20(b) (II) (C), 22, 29 of the N.D.P.S. Act.

16 kg. Ganja is said to have been recovered from conscious possession of the petitioner for which petitioner is in jail custody since 04.08.2018. Petitioner does not have any criminal antecedent which is evident from perusal of para 3 of the petition. However, co-accused, Arvind Mahto @ Arvind Kumar and Birendra Mahto have already been ordered to be released on bail after completion of one year in custody. Considering the aforesaid facts and circumstances as

Patna High Court CR. MISC. No.3450 of 2019(5) dt.28-03-2019 2/2 well as submissions of the parties, I am not inclined to release the petitioner on bail for the present and accordingly, his payer for bail in connection with Sonepur (Hajipur) Rail P.S. Case No. 96 of 2018 stands rejected.

However, petitioner may renew his prayer for bail after completion of one year in custody.
