JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Section 394 of the Indian Penal Code. Petitioners are not named in the first information report but it appears from perusal of the impugned order that looted truck was recovered in Khagaria district for which Alauli P.S. Case No. 251 of 2015 was registered and petitioners were arrested in the aforesaid case and, thereafter, petitioners were remanded in the present case. Moreover, it appears that except confessional statement of co-accused as well as petitioners, there appears to be nothing against them. Petitioners are in jail custody

Patna High Court Cr.Misc. No.17400 of 2016 (2) dt.28-04-2016 2/2 since 21.01.2016 but up till now, they have not been put on Test Identification Parade.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Atul Kumar Singh, Judicial Magistrate 1st Class, Samastipur in connection with Musrigharari P.S. Case No. 131 of 2015.
