The petitioner has filed the instant application for grant of regular bail in connection with Koransarai P.S. Case No. 26 of 2022 registered under sections 392 and 34 of the Indian Penal Code and after investigation, police has submitted charge sheet under Sections 395 and 412 of the IPC. The allegation against the petitioner along with other co-accused persons is to commit robbery where charge sheet has been submitted for dacoity, while committing so taken away cash of Rs. 3,000/-, one bullet motorcycle and mobile which belong to the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

The petitioner is not named in F.I.R. rather his name came into light in this case during the course of investigation on the basis of confessional statement of other co-accused person, namely, Abhishek Yadav before the police. It is further submitted that neither any stolen article has been recovered from the possession of the petitioner nor he has been put on T.I.P. During investigation no any cogent material came against him to implicate in this alleged offence. Moreover, he is languishing in judicial custody since 25.05.2022. Similarly situated other coaccused person has already been granted bail by the different co-ordinate Bench of this Court vide Annexure-2 of this petition.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as the custody of the petitioner, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Koransarai P.S. Case No. 26 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each
