In this case, the petitioner is seeking regular bail in connection with Nawada Town P.S. Case No.130 of 2016, registered for the offences punishable under Sections 366(a), 370, 372 & 373 of the Indian Penal Code.

Allegation has been made that the informant received secret information with regard to marriage of a minor girl with a person double in age. The police came there and arrested all the persons who were attending the marriage.

The statement of the victim-girl record under Section 164 of the Cr.P.C. shows that the wife of the petitioner was the main actress to arrange the marriage of the minor girl.

No.17290 of 2016 (2) dt.28-04-2016 2/2 Having considered the facts and circumstances of the case, let the petitioner-Moti Ram be released on bail on furnishing bail bonds of Rs.10, 000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Nawada P.S. Case No. 130 of 2016 subject to the conditions that:- (i) one of the bailors will be a close relative of the petitioner;

(ii) if the petitioner is found involved in similar type of case in future, the prosecution will be at liberty to make prayer for cancellation of his bail and the Court below will pass necessary order, including cancellation of bail and;

(iii) that the petitioner would participate in the court proceeding and in the event of being absent on two consecutive dates without reasonable explanation, the court below will be at liberty to cancel the bail bonds of the petitioner.
