The present writ application has been filed with a limited prayer for appropriate directions commanding the respondents, especially the respondent no. 8 to institute a first information report on a complaint dated 17.04.2017 and a further direction to investigate the same by an officer above the rank of Inspector of Police as well as to provide

Patna High Court CR. WJC No.876 of 2017(2) dt.23-01-2020 2/2 security/protection of the petitioner.

Though, there is no appearance on behalf of the petitioner to support the writ application, learned counsel appearing for the State submits that the grievances of the petitioner have already been redressed and the first information report has now been instituted bearing Danapur P.S. Case No. 376 of 2017 dated 15.06.2017 under Section 341, 379, 385, 504, 506 and 34 of the Indian Penal Code which is evident from Annexure- 10 of the counter affidavit filed by the respondent nos. 5 to 8. The Sub- Inspector of Police, Rupak Kumar has already been authorized to investigate the aforementioned case. Learned counsel for the State submits that the present writ application has been rendered infructuous and may be disposed of.

Considering the aforementioned submissions as advanced by the learned counsel for the State, the present writ application stands consigned.
